41    INTANGIBLE FIXED ASSETS
      These comprise two trade names used and trademarked by the company, being
      ‘Alternaturfly better’ and ‘Jagger sports turf It is not considered that they have any
      value

4.2   BOOK DEBTS

      The figure shown for book debts ts that extracted from the company’s books In arriving
      at the realisable amount, specific bad debt reductions of £65,009 have been made and
      a general provision of 20 per cent applied against the remainder for the sake of
      prudence

4.3   OTHER DEBTORS

      The company has a number of claims against former agents for breach of agency
      agreements Any recoveries under this head will only be likely after legal proceedings
      and a substantial discount has been applied of 70 per cent for the sake of prudence

4.4   CASH AT BANK

      The company has approximately £1,000 in a bank account with National Westminster
      plc which will be realised in full Additionally, the company paid £5,000 to its instructed
      solicitors, The Betesh Partnership, Manchester, in relation to certain legal proceedings
      It is estimated that approximately £3,000 will be due to the company from this source
      from which it is understood that certain solicitors’ fees and disbursements have already
      been deducted

4.5   STOCK

      This represents various items held by the company, such as spare part stocks for
      equipment and other items of stock Because much of this stock has been held for
      many years, tt has not been possible to extract from the company’s accounts a realistic
      book value figure and so the book value is shown at the replacement cost value

4.6   PLANT AND MACHINERY

      This represents equipment used by the company in the supply and laying of turf The
      book value figures have been extracted from the company’s financial accounts
47     FREEHOLD LAND AND BUILDING

       This represents items of equipment purchased by the company and which were
       installed into the freehold premises not owned by the company. These items
       comprised roller shutter doors and oil/refuse tanks The director believes that it would
       not be economical to remove for sale the roller shutters which were manufactured to fit
       the properties in question nor would the oil/refuse tanks have any value, once the costs
       of draining and cleaning them have been taken into account

4.8    FURNITURE AND EQUIPMENT

       This represents desks, chairs, computers    It is estimated that they will realise £500

4.9    MOTOR VEHICLE

       The company owns a     ‘Y’-registered Isuzu Trooper motor vehicle which it is estimated
       will realise £1,500

4.10   THE PRESCRIBED PART

       This ts the amount available and to be set aside for the unsecured creditors from the
       assets covered by the floating charge, calculated in accordance with statute

       PREFERENTIAL CREDITORS
       The director advises that there are no outstanding claims for wages or holiday pay
       Similarly, he is unaware of any other potential preferential claims because the
       employees of the company have transferred to his new trading entity

4.11   FLOATING CHARGE

       This represents funds injected into the business, as set out in the History of the
       Business by Mr and Mrs Hodgkinson, to clear the Yorkshire Bank overdraft The
       debenture was created on 9 September 2008, when the funds were injected to clear
       the bank borrowings which, in themselves, were subject to a fixed and floating charge
       debenture over the assets of the company

4.12   TRADE AND EXPENSE CREDITORS
       Trade and expense creditors are shown in the amounts advised by the director to be
       outstanding tn the books and records in the company The figure detailed in the
       estimated Statement of Affairs is subject to the agreement of creditors’ claims
       Creditors’ amounts include VAT where applicable

4.13   HM REVENUE & CUSTOMS

       An amount of £2,258 Is outstanding for VAT up to the date of liquidation
       Additionally, the company owes approximately £43,000 in respect of PAYE and
       national insurance contributions
4.14   DIRECTORS’ LOAN ACCOUNTS

       These are the amounts outstanding to the director/former director, as broken down
       below -

4.15   VALUATIONS

       The assets referred to in paragraph 5,6 and 9 have all been valued by Mr Harper
       (Qualifications Higher Diploma tn Land Use studies including the course in Estate
       Management and Valuation) of Messrs King Sturge The remaining assets have been
       valued by the director
